What if the I 94 is expired and an H1B extension is filed and still waiting for the Approval?
Will that one will also be rejected or by attaching the receipt copy will be good enough?
Expired I-94 is ok, if
it is expired less than 180 days ago. 245(k) covers this.
or
change of status to H1/H4/L1/L2 is pending. In this case, attach copy of the receipt.

As per my understanding 10 days is from the time you change your permanent address. Due to lease constraint I also had two apartments at same time. I filled online AR-11 within 10 days after I moved to new apartment.

Hi all,
One of my relatives who has been here in United States for last 10 years keep on telling me that there is a co-relation between Expedition of Green Card process and election year.
I am planning to switch my job as I am having a great offer, but he kept on telling me that in the past, he has noticed great expedition of green card process during the election years. He advises me against switching the job at this point. My PD is Jan 2005.
Please let me know, if any of you agree with him.

If you work for a consulting firm requiring you to work for clients at various locations your labor application should have stated as various locations within US instead of one location. Since your labor was filed in 2002 i assume it was using old labor process (State labor than Regional thru BEC), the rules for that labor filing state that Company should file the state labor in the state where it is headquartered if employee is supposed to working at various locations. My labor was filed that way and application stated location as various within US. If you had that than it should not be an issue.
On March 12 2009 I got an query on my I-485.

Hello,
I am on H1. I got laid off in March 2009 and have not got anything since then. So I dont have lot of amount in my W2 for this year I have my H1 extension (after 3 years) coming up next year (2010).
My employer advised me to run payroll taxes for rest of the year, so that we could get W2 which would be helpful for H1 extension.
I have following Questions - Is W2 required for H1 extension or would few pay checks suffice?

What is required for a H1 extension is a "JOB". You should try and get a job asap. Technically, you are accruing unlawful presence in the US since the day you are out of the job (unless you have a pending I-485). On top of that, what your employer is suggesting is illegal. Try to find a job asap and apply for H1 COE petition. You will be required to submit your latest paystubs though.

I have talked with lawyer regarding this.
She has the following to Say:
a) Ac21 is perfectly legal thing and many of her clients are traveling on AP under AC21 and do not have any issue.
b) CBP officers know about this and there is nothing to worry.
c) If the CBP officer is getting two suspicious they can't deport me. They have to parole me and then run a case or check on me. Where my lawyer can talk with them and make thenm understand that everything is OK
d) she assures me that there is nothing to worry and I can go and come back hassle free.
Do you people think all of these statements are correct?

Friend of mine got her DL renewed for 1 yr based on EAD as her h1b extension is not approved yet.DMV ppl look at her EAD and renewed her DL for 1 yr without any questions. So i guess you are fine with yr DL extension for 1 yr. As per my understanding and some of the posts , i think you won't loose yr H1b status as you are not using EAD for employment. And answer to yr last question is my frd got her DL renewed in VA only. She got it at DMV on Gallows Road, VA (it's in Fairfax,VA). Hope this helps.

2- I moved business travel around the rally, my boss also had to reschedule
3- I am flying in from Texas

Yeah, H-1B is a dual-intent visa where you are allowed to apply for permanent residency besides temporarily working in US...so, unless there are any specific Malaysian Immigration restrictions, your US Consulate in KL should not be asking you for any proof of air ticket purchase.
Having said that, this list of additional supporting documents that they might ask is not standard across various consulates. So, it is better for you to directly get a list of "additional supporting documents" that they have on radar either through the consulate or any of your Malaysian friends/network.
Since it is a H-1B extension, at the bare minimum, you should carry the certified copy of I-129 by your immigration attorney, most recent employment verification letter signed by your supervisor, most recent pay statements, W2s and bank statements. This is in addition to your I-797 original, original educational degree certificates, a copy of your resume and the completed DS-156, DS-157 forms.

I just got my Labor approved (PD - 2/22/2008) . Attorneys are working on filing I-140.
1. Shall I wait for I-140 PP to re-instate or go ahead with normal processing?
2. Is there 'ANY' chance that my PD will be current before I get I-140 approval when filed through normal processing?

Sources indicate that the initial schedule has been somewhat pushed off. However, the DOL website still promises that they will eliminate all the backlog cases in 14 months. The period of 14 months may be a long time for the immigrants but a short time for the agency to eliminate tons of complicated labor certification applications. This is particularly true in that as the elimination program approaches the end of the rope, the morale of the temporary workers that manage, operate, and process applications is expected to drop substantially.
* The late slow-down of the pace of processing of the backlog applications raises a misgiving that unless the agency works out a special procedure or device, they may not be able to reach the goal.. There are still tons of traditional applications that await a time-consuming supervised recruitment process and adjudication including audits. If she uses her H4 Visa stamp to enter , will have to file H4 to H1 Chane of status to be able to work on H1.
She should be able to enter on H4. Then apply for COS from H4 to H1 when she is in US. This should take about 3 months.
If possible, get the H1 visa stamped while in India. She can then enter on H1.
I think there should not be any issues either way...

My 6th year h1b is expiring on April 30, 2008. I applied labor through PERM on October 1, 2007. How to stay legal in this country until approval of 140. Converting to F1 or B2 will cause any problems to green card process. Please advice.
