Contract terms require "consideration" from both parties to be legally binding. Consideration is something you provide to the other party (i.e., money from you, data services from your carrier).
What consideration are the carriers offering you for tethering? You're already paying $X for Y GB of data used on your phone. It doesn't matter to the carrier if your Netflix app is using it, or your tethering app is sending the data to your laptop. Nothing changes on their end, they just send the data that you've already paid for to your phone, and your phone handles the rest.
You're right, it is black and white. It's a scam aimed at exploiting consumers like yourself who don't know any better, with an illegal contract term. I hope this goes to court soon, before the carriers in Canada (where I am) try to pull the same BS.
Obviously you have learned about contracts, but have no practical experience with what the terms you are using actually mean...

If you start hooking up the whole neighborhood through your home Internet connection, they would be well within their rights to charge you more money.

How many menus do you have to go through to share a folder ? Change an IP address ? Change networks order ?
Can you even change interfaces (or "service") order ? I like my Mac to use Ethernet for Internet when I'm connected to both Ethernet and Wifi. Can Windows do that ?
Can you set up "Locations" ? No, not that stupid "Home, Work, Public" wannabe-secure popup-everytime BS.

Im quite torn. The 20" Cinema Display is cheaper than the dell BUT the limited adjustability is turning me off plus the fact that the UK specs are still yet to be updated. The Dell is an obvious better buy but it just doesn't look as good as the Cinema Display and its resale value won't be close to that of the Cinema Display.
I dont know why apple made the adjustibilty so limited. Even steve tends to bend his head at times to see the display he uses properly.

You can say that about any consumer product.
Speaking in general terms, MS has added more to windows, improved performance and reduced the bloat with win7.
Apple has gone the opposite direction, adding bloat and no major feature since 10.5
+1. Hopefully Lion will be worth the added system requirements.

This is nonsence. If the average user was interested in just Apple, then why are Apple on a lesser market share for pretty much... everything but MP3 players? How come Android is proving more popular?
You mean all the junk Google flooded the market with in order to inflate their share because they *still* can't make anything even remotely on the level of the iPhone?
Licensing out your OS to anyone that can slam together a box and unloading product via the likes of ZTE and cheap Asian outfits (i.e., the "other" category) is hardly impressive. It's the Wintel way of dong business. Great for pumping up market share, but the profits go to the cream of the crop: Apple. For the rest it's a race to the bottom.

I'm seeing Apple discontinue server services. I'm seeing Apple making silly mistakes such as clock bugs and adding social networks to media players. I'm seeing Apple still not improve MobileMe.
You're seeing Apple hit new milestones and the competition keeping up the only way they know how: price and universal licensing. ZTE releases more Android junk and HTE releases their 20th variation of the same phone and it's crickets. Meanwhile there's so much as a hint of a new iPhone and the industry and market is just buzzing with excitement. The reason is simple: when it comes to Apple, consumer anticipation is in line with expectation.
As for the rest, Apple is following the same formula they always have. It's the ideal of engineering and design: simplify, simplify, simplify. Cut, cut, cut. Then perfect what's left over.
This is what results in record sales. With profits to match.

But your story doesn't surprise especially if you can come from the UK. iPhone did slip out of the TOP 5 in sales last year. I believe the HTC Desire was the most popular one. One of my favorite reviewers from the UK is James Whatley. He reminds me of Brandon Flowers from The Killers. He despises Apple with a passion. He works for Nokia now, so call him one of those diehard Nokians.

I have tried Verizon. It sucks. Even with the discount I get for working for GM it still sucks. Droped calls all the time. Half the time the conversation cut in and out and both sides would have to repeat their selves. And their customer service sucked too.
I have had no problems with AT&T and have had great customer service. I think ill keep my network.

Congratulations, you understood the main purpose of the iPad. Add Plants vs Zombies, Shredder Chess HD and a Comic Book reader and you've essentially discovered everything that can be done with the gadget. For everything else, it's too big to be a truly mobile device like a smartphone and too weak and restricted to replace a real computer.
But yes, at least the ads are great and really work the "magic". The only problem is that you won't stay in Wonderland with your iPad, and in the real world, it's just a nice toy for a couple of minutes but not really good for anything.
